you mean in the US right? in what regard, to humans or to envinronment? DEA, I believe for humans. EPA for the environment. just hazarding a guess.
Each country has different agencies, it also depends on what the substance is. (EPA, HSE etc.)

There is not one agency that will determine this. Instead you will find definitions and criteria. Anything that meets the definition / criteria is considered hazardous.

It also depends on what hazard you are talking about. For instance, flamability is defined in the Occupational Safety & Health Administration (OSHA). Any substance that meets the defined criteria is therefore hazardous.

Toxicity is defined by the Centers for Disease Control / Nat'l Institute for Occupational Health and Safety. CDC/NIOSH
NIOSH will develop permissible exposure limits (PEL's)

Environmental hazards are defined by the Environmental Protection Agency.
