How can I get my father commited to a mental hospital. I'm 35 years old, he is 65? DO I need a lawyer?

This question cannot be answered without a whole lot more information. Is it depression? bizarre behavior? forgetfulness? indecent acts? I'm an RN for a home health agency and I help families take care of numerous patients with all stages of dementia at home. What I have seen is that committment to a mental hospital is pretty much a temporary thing for stabilization and then the patient is released back to his own environment. An exception to this would be if he is criminally insane, in which case I don't think he would have made it to 65 without having been locked up. I question if you're not just asking out of sheer exasperation in which case the family physician would be the best place to start. A great deal of mental problems can be greatly improved with psychiatric meds. Need to start there anyway; I wouldn't think you could find any way to just jump in with an attorney and get him committed.
Talk to a psychiatrist or social worker first. It is easy. Have him put on an M1 or 72 hour hold. It happens every day.

In order to have anyone involuntarily committed to a mental hospital, the patient has to be a danger to himself or to another person. Depending on the state, 1-3 mental health professionals will have to certify that the patient meets this standard. Usually, the involuntary commitment is only good for 72 hours and is then reevaluated on a semi-regular basis thereafter. The point is that it is very difficult to have someone committed for a prolonged period of time unless they are a serious threat. Of course, if the person would be willing to go into the hospital voluntarily the admissions process would be quite different.
If in the opinion of a psychologist or psychiatrist he needs to be committed for his safety or that of others, they can have him placed in a hospital.
