What a ridiculous question. I would want to sit next to neither. The heroin addict might rob me, but the smoker would be disgusting and smelly and passive smoking kills.
Its like saying would you rather sit next to a flasher or a murderer to try and justify that flashing is ok.
Since I've sat next to many smokers AND many heroin addicts...I would choose the heroin addict.
What you have forgotten is this. The heroin addict will not necessarily steal from you but the smoke from the cigarette (assuming the smoker is smoking - you didn't actually write this) will definitely be a nuisance.

Well I end up with both in my job. You can't judge a person by an addiction. Would you sit next to a person with an eating disorder or with a sex addiction? Think about it. We are all human and made mistakes at some stage in our lives.
I would prefer a heroin addict because i know that i have to be aware of this guy and watch over my property (install security alarms and keep an eye); moreover the heroin addict is only harming himself.
Whereas the smoker is killing me constantly..and slowly,
I would sit next to the heroin user. At least if s/he shoot up heroin s/he is doing damage to themselves, where as I don't want the passive smoke from a tobacco user. That said, if the heroin user was chasing/smoking heroin then I would be in a different predicament, however, I would offer help to the heroin user as most heroin users (but not exclusively so) tend to have deep emotional and psychological problems.
That said, who is to say that the tobacco smoker hasn't bought his/her cigs illegally without paying tax when via duty free? And who is to say that all heroin user commit crime to pay for their drug of choice?

One has a legal drug and the other has an illegal drug. You claim one steals to support his habit. If both were legal, we could sit next to either of them and feel safe. Change the laws and you are safe either way. Beside, I think most criminals smoke anyway. So how do you KNOW the smoker will not steal from you. S/he is willing to kill you with second had smoke and make your trip as uncomfortable as possible. Give me the herion addict. I think I can protect myself better.

Well I would get up and move, I don't want to be poisoned by a smoker and if some manky junkie even tried to rob me I'd kick his ***!
There is NO place in society for people who do not care about there's or anyone Else's health.
i might have already sat near a heroin addict without knowing it in a waiting room for instance. And even if i knew it, as long as this person is not causing any nuisance to me i'd sit near him/her but not the smoker: i wouldn't seat in the same room for the only reason that i can't bear the smell of cigarettes and would think it rude that he/she would force such a toxic smell upon me.
i would prefer a smoker considering i am one,drugs are worst and more expensive.and people that take drugs are in terrible states .
I would sit next to the heroin addict because I hate the smell of cigarette smoke and don't want to die as a result of passive smoking. Your comments about heroin addicts are rather harsh, they're not all thieves and your question refers to sitting next to one so how does that end up with them stealing from "you and yours and your home"?
